Standard Possession Order

Texas has a Standard Possession Order that outlines the amount of time a child spends with their parents. It is presumed to be in the best interests of the child. In general, the Standard Possession Order applies when parents cannot agree about scheduled visitation, but not always.

The order addresses a variety of family situations and may include provisions regarding:

  • Children under the age of three
  • Time spent with parents over holidays or during special family traditions
  • Parents who live less than or over 100 miles apart
  • Parents dealing with interstate visitation issues

Modifying a Visitation / Parenting Plan

As life moves on and the children age, an existing visitation plan may no longer fit the needs of the parent or the child and need to be modified. Furthermore, if there have been allegations of abuse or a parent is deemed unfit, the original visitation schedule will need to be modified for child protection purposes.

Before finalizing any modification, the court will consider a variety of factors, including:

  • The well-being of the child
  • The relationship between the child and parent
  • The financial circumstances of both homes
  • The emotional distress that may occur if visitation plans are changed
