How Uncontested Divorce Works
Usually there is only one attorney involved in an uncontested divorce. However, that lawyer still represents only one of the parties--the other party simply signs the required documents, possibly after consulting briefly with his or her own attorney. The other party frequently does not need to be present at the final hearing once the necessary waivers have been signed. Texas requires a 60-day waiting period for a divorce to become final after the initial petition has been filed.
