Child Support
Austin, Texas, Child Support Lawyers
In Texas, child support is often allocated according to a set formula. However, determining child support can still be complicated. At Ritchey & Marbut, L.L.P., we help clients determine their likely need for child support by analyzing their situation in light of the Texas Child Support Guidelines For more information on these guidelines, or about child support, contact the family law attorneys at Ritchey & Marbut. We want to help.
Complications in Child Support Calculations
While the child support guidelines eliminate much of the guesswork in calculating child support amounts, some flexibility remains. For example, the guidelines may not apply when:
- One parent lives a great distance from the other, increasing the cost of visitation for the other parent
- The income of one spouse is higher than the maximum in the guidelines
- A child has special needs
- One parent has assumed a larger share of the community debt
Our child support lawyers can help you determine whether any of these exceptions apply to your circumstances.
Enforcement of Child Support Orders
If the parent providing child support is delinquent in paying, the Texas Attorney General's Office can take action to make sure that support is provided. These actions can include suspending state licenses for professionals, filing liens against property, and requiring employers to deduct child support from paychecks. Whether you are either the recipient of child support or the delinquent payer of child support, we can help. We will discuss your options and recommend a course of action.
Changes in Circumstances that Affect Child Support
We can help parents file applications to modify the existing support orders if there are changes in circumstances. Changes related to child support can include:
- A change in the obligor's income
- One parent moving from the area, increasing the cost of scheduled visitation
- A significant change in the child's needs
To adjust support payments in light of new situations like these, our attorneys can help. We can help determine whether you have grounds to seek a modification of the original order and we can request a modification of the child support order or decree on your behalf.
